A ruling overturns a provision designed to curb the conversion of single-family homes into rental units in Newark for University of Delaware students.

"The city of Newark unfairly discriminates against University of Delaware students and landlords through ordinances regulating rental housing...In his opinion... [the judge] said the ordinances violated the Delaware Fair Housing Act, which prohibits discrimination in rental housing based on marital status... Noble also ruled illegal a city ordinance that said a rental agreement must state a lease can be terminated if a tenant is convicted twice for violations of ordinances such as those prohibiting disorderly conduct or excessive noise. The code and city ordinances were developed in response to concerns over the years about the growing number of students in residential neighborhoods and complaints about their behavior."
