The agreement allowing public access on the private walkway was signed in February 2002 by officials representing the building and city. It says the "easement property shall be perpetual" but says it can be terminated under any of four conditions, including "development of a structure within the area of the Plaza that encroaches on the easement." Frank Hudson, a deputy city attorney, said "It's the sort of argument that only a lawyer would make," Hudson said. "They're saying the fence is a structure."
