An Albany, NY, neighborhood association beats back a legal challenge that could have had far reaching implications for property owners' standing to sue over zoning decisions.
The association vice president said they had no choice but to appeal, since the ruling could set a precedent that would prevent historic preservation groups, environmental groups, or even regular property owners from challenging zoning decisions. It basically gave developers and zoning boards carte blanche to do whatever they want, she said, noting that zoning boards already frequently take the chance that property owners wont come up with the substantial sums required to bring a legal challenge to their rulings.
