A small town on the Jersey Shore has turned into a battleground in the eminent domain debate.
"Today, Anzalone, 88, and his 89-year-old wife may lose their home to eminent domain -- the government's power to seize private property for public use. And their neighborhood of 36 properties has become a flashpoint in the national battle over eminent domain that has erupted since the U.S. Supreme Court ruled in June that cities and towns can seize private property for economic development projects.
The city of Long Branch wants to seize the Anzalones' home and other properties in the Video iconMarine Terrace, Ocean Terrace, Seaview Avenue neighborhood and turn the land over to a private developer, which would demolish the houses and replace them with 185 oceanfront condos, many with price tags likely to top $1 million.
But, with bulldozers literally next door, the Anzalones and 23 other neighborhood residents are battling the city in court to save their homes."
