Growth Control Challenged In Court

California's City of Tracy is facing a lawsuit from a developer claiming that its recent growth control measure goes too far.

Measure A, an act passed by Tracy city voters in November tolimit new city growth, is being challenged by a group of localdevelopers. Tracy Allocation Group LLC has filed a lawsuit claiming thatMeasure A’s limit of an average 600 new houses per year, down from1,200, stunts necessary growth and is incompatible with the city’sgeneral plan. Although Measure A has yet to be implemented, supportersargue that developers should be subject to the new limits for theircurrent plans to build 2,200 to 5,800 new houses. Supporters contendthat the even the old law, which allowed 1500 new houses to be built ina year, was a maximum number, and not a guaranteed number of new houseseach year.
