Illinois Court Ruling Supports Condemnation

Illinois' condemnation powers get a boost from an appeals court ruling that enables staff or attorneys to negotiate prices for condemnations.

"By siding with the DuPage County Forest Preserve District in a condemnation case, a state appellate court shored up support for governments across the state in acquiring private property for public use." The ruling overturned last year's decision by a DuPage County Circuit Court judge, who ruled a Forest Preserve District ordinance was unconstitutional because it delegated condemnation powers reserved for elected leaders to the district's attorneys and staff.
