For 17 years land owners have been banned from building on their own property at Lake Tahoe. Finally, an outcome is near.
The Regional Planning Agency for Lake Tahoe denied several hundred families from building homes around the Lake while others, some next door to those denied, were given permits to build. The planning-board alleged that runoff from certain of the properties would pollute the mountain lake. The temporary moratorium has extended to 17 years. The land owners want compensation, stating that the planning agency has violated the 5th Amendment to the Constitution, which says "private property shall not be taken for public use without just compensation." The US Supreme Court has agreed to hear the case.
