Builders in McHenry County, Illinois are going to court over what they say is the unfair collection of impact fees.
In suburban Chicago a home construction boom in the 1990s has led to overcrowded schools in some communities. To compensate schools for the influx of students, counties levy impact fees on new home construction. But home builders are challenging the way one county levies those fees. By filing suit, the builders hope to force the state of Illinois to impose a uniform collection formula. But if they win, schools may have to refund millions collected over the last 10 years, money they can't afford to part with.
