A new report shows that smart growth measures are most successful in states where planning statutes have been modernized.
"The zoning law, known as Chapter 40-A, virtually guarantees sprawl-style development, Russell said. One rule allows developers to build single-family homes on existing roads without any review by local planning boards.There is also no requirement that local planning guidelines be enforced through local zoning, Russell said. And if cities and towns try innovative new planning methods, Massachusetts law includes a liberal ''grandfather'' clause that allows landowners to hurriedly submit plans that are not subject to any new rules."
