Property rights and open space preservation will clash once again in Colorado, if a new bill preventing counties from seizing private property for the creation of open space moves forward.
The Associated Press reports on a bill under consideration in the Colorado state Legislature that would prevent county governments from using eminent domain powers to acquire private land for use as open space, parks, or for purposes of conservation.
State Senator Larry Crowder proposed Senate Bill 15-114 [pdf] in reaction to a 2014 controversy in Summit County, when a family was forced to sell ten acres of mountain property in the White River National Forest.
