Builders Scream Foul

The National Association of Home Builders says planners are overreaching in their interpretation.

"The National Association of Home Builders are up in arms over a U.S. Supreme Court decision in April that ruled in favor of a growth moratorium enacted in the Tahoe, Calif.-area and which brought to an end a case that had spanned 20 years. ... Moratoria are admissions of planning failure," said Bauman, an attorney with the law firm Beveridge and Diamond in Washington, D.C. "A moratorium is the most severe growth management mechanism possible, and in many cases it may be an invalid growth management mechanism. Because of this, a moratorium should be used with caution and only under special circumstances."
