Public Hearing Procedures Questioned

The Illinois Supreme Court put local governments on notice that all parties must be given the floor during land use related public hearing proceedings.

"Residents now will have more time and opportunities to speak during certain public hearings before the Naperville Plan Commission and Zoning Board of Appeals as part of the new process, as recommended by Naperville legal director Daniel P. Blondin. Future land-use hearings before those two boards could come to resemble the give-and-take of civil- or criminal-court trials. Blondin said audience members, like Plan Commission and ZBA panelists, will have the opportunity to cross-examine landowners, developers, architects, attorneys, city planners and other 'witnesses' involved in those hearings."
